The 2025 Florida Legislative Session ended on Mat 2, 2025, but without the legislators agreeing on a budget, the only thing that is actually mandatory. It surely was a very disappointing session for homeowners in mandatory associations. The very promising HOA bill (HB 983) sponsored by Representative Juan Carlos Porras included very good provisions trying to rein in financial crimes running rampant in Florida's mandatory homeowners' associations. The bill made it through two committees unanimously with bipartisan votes, only to be killed by Speaker Daniel Perez behind closed doors. Obviously Perez rather protects his friends in the community association industry than more than 2.5 million homeowners' association property owners. The same goes for his stance on tax breaks for Florida's citizens. Hopefully voters will remember this next year in November and will only give Perez their vote if he runs for Miami-Dade dog-catcher!

Below is a list for all the bills filed for HOMEOWNERS' ASSOCIATIONS regulated by Florida Statute 720. Not one of these bills even made it to a floor vote. It tells you how our legislators feel about property owners in Florida's HOAs.

SB 120: Homeowners’ Association Ombudsman

GENERAL BILL by Senator Danny Burgess    

Companion Bill (Identical) : HB 137

Homeowners’ Association Ombudsman; Creating the Office of the Homeowners’ Association Ombudsman within the Division of Florida Condominiums, Timeshares, and Mobile Homes of the Department of Business and Professional Regulation; providing that the ombudsman serves at the pleasure of the Governor; prohibiting the ombudsman and officers and full-time employees of the office from holding certain positions, engaging in certain activities, or receiving certain remuneration; providing for the administration of an election monitoring process, etc.

Homeowners' Association Ombudsman; Creates Office of Homeowners' Association Ombudsman within Division of Florida Condominiums, Timeshares, & Mobile Homes of DBPR; provides for funding of office; directs Governor to appoint ombudsman; provides requirements for ombudsman; prohibits ombudsman & officers & full-time employees of office from holding certain positions, engaging in certain activities, or receiving certain remuneration; provides for principal location of ombudsman's office; specifies powers & duties of ombudsman; provides for administration of election monitoring process; provides that specified rule governs administration of election monitoring.

Community Associations; Creating the Condominium and Homeowners’ Association Economic Crime, Fraud, and Corruption Investigation Pilot Program within the Department of Legal Affairs; authorizing the department to contract with a private entity to achieve the program’s purpose; requiring that the pilot program be funded from the Division of Florida Condominiums, Timeshares, and Mobile Homes Trust Fund; requiring the division to monitor condominium associations’ compliance with requirements relating to maintenance of certain insurance or fidelity bonding of certain persons, etc.

Homeowners' Associations; Revises, provides, & removes provisions relating to recall of board members of homeowners' associations; specifies when board member is delinquent in paying assessments; revises & provides requirements relating to election & recall disputes; attorney fees; requires certain documents be provided to prospective purchasers before executing contract; provides certain powers & authority to local law enforcement agencies.

SB 1600: Community Associations

GENERAL BILL by Senator Kristen Arrington   

Companion Bill (Compare) : HB 913HB 983

Community Associations; Prohibiting the suspension of a voting interest of a condominium when voting to recall a member of the board of administration; prohibiting any prior suspension of voting rights from having any effect; providing that all election and recall arbitration conducted by the division is binding on the parties unless such arbitration is removed; requiring that the notice of removal and complaint be signed pursuant to the Florida Rules of Civil Procedure and include copies of certain documents served in the action; requiring that an association be ordered, by judgment or decree, to pay all of a prevailing unit owner’s costs, including reasonable attorney fees and costs, etc.

If you own a unit in a CONDOMINIUM ASSOCIATION regulated by Florida Statute 718 or in a CO-OP regulated by FS 719, below are the bills that will directly affect you. Actually only two of all these bills are making it to the Governor's desk. While HB 393 (My Safe Florida Condominium Pilot Program) will help many condo associations with paying for many of the structural repairs necessary. The verdict on the 191-page safety bill CONDO 3.0 HB 913 is still out. It looks like there are quite a few provisions in this bill where even the specialized attorneys have a problem to correctly interpret these complicated provisions.

SB 690: Condominium Structural Integrity Reserve Studies

HB 1415: Structural Integrity Reserve Studies

Structural Integrity Reserve Studies; Defines "structural integrity reserve study"; requires condominium & cooperative associations that govern building of specified height to conduct structural integrity reserve study for specified purpose; provides that condominium & cooperative associations that govern building that does not meet such specified height requirement are not required to conduct structural integrity reserve study; authorizes certain condominium & cooperative associations to elect, by majority vote of unit owners, to waive or reduce reserve contributions.

SB 1742: Condominium and Cooperative Associations

Condominium and Cooperative Associations; Revising the methods of delivery for a copy of the most recent association financial report to include electronic delivery via the Internet; authorizing a unit-owner-controlled association to obtain a line of credit in lieu of maintaining reserves for budgets adopted on or before a specified date upon a majority vote of the association; revising the disclosures that must be included in a contract for the sale and resale of a residential unit; requiring a board to use best efforts to make prudent investment decisions in fulfilling its duty to manage operating and reserve funds of the association, etc.
