ANALYSIS OF BILL HB 811

HB 811 (Summary): Condominium Association Complaints and Investigations

We should strongly support bill HB 811, entitled “Condominium Association Complaints and Investigations,” filed by State Representative Tom Fabricio on December 1, 2021.   

 

Background:

HB 811 relates to investigations and complaints of alleged criminal activity occurring at residential condominium associations.   

HB 811 is the “companion bill” to SB 274, entitled “Condominium Fraud Investigation Pilot Program” filed by Senator Ana Maria Rodriguez  on September 21, 2021.  . 

On  October 13, 2021, SB 274 was referred to  committees (and subcommittees) relating  to regulated industries, (including  residential condominium association complaints and investigations) as well as  subcommittee appropriations.

The aim of HB 811 relates to investigations and complaints of alleged criminal activities and the enforcement of same.   This is common sense, its good public policy, and may lessen fraud or other criminal activities.  In fact, the slogan on that should be “don’t do the crime, if you can’t do the time”

HB 811 requires that  specific methods in hiring personnel,  including the use of retired law enforcement who are have experienced on financial fraud matters and are certified to investigate complaints,

In addition, HB 811 requires specific methods for hiring personnel, including the use of retired law enforcement officers

HB 811 amends s. 718.501, F.S.; to require the Division of Florida Condominiums, Timeshares, and Mobile Homes to forward certain complaints to the Department of Law Enforcement; and sets specified timeframes to review complaints, and to take appropriate action .
