THE FALLEN TREE ACT

We all know that a lot of damage during hurricanes is caused by fallen trees or "flying" branches. And -- until now -- owners of trees are not liable for damages caused by their trees on neighbors' property.

Two legislators have now filed bills to change this and hold owners liable for damage caused by their trees.

State Representative Nan Cobb (HB 599) and Senator Jonathan Martin (SB 724) filed bills for the upcoming legislative session that create the necessary liability for tree owners. Many other states already have such laws in the books!

We all know that the next hurricane is on the way. We just don't know where exactly it hits Florida -- and when!

Such a law is long overdue and if enacted, it will not only reduce the amount of damages caused by trees, it will as well make sure that owners take care of their trees. Trees require maintenance and a well-maintained tree is less likely to cause damage if the hurricane hits.

Let's make sure that legislators know that this change to the tree liability laws is much appreciated by all homeowners and that the bill ends up on the Governor's desk for his signature without being watered down by special interests.
