2026 Florida Legislative Session


Below is a list for all the bills filed for HOMEOWNERS' ASSOCIATIONS regulated by Florida Statute 720. Please watch especially for HB 657. This bill is trying to allow owners to dissolve their HOA and would create the community association court.

HB 465: Community Association Management

General Bill by Representative Danny Nix

Companion Bill (Compare) : SB 822

Community Association Management; Requires certain community associations to contract with community association management firm; requires community association firm to possess all applicable licenses; provides that association board members, officers, & directors have duty to ensure such community association firm or community association manager is properly licensed.

Companion Bill (Compare) : 

Community Associations; Removes presuit mediation requirements; requires associations to include specified statement in their governing documents or to hold meeting by date certain to vote to amend governing documents to include such statement; requires that specified arbitrators conduct arbitration proceedings; authorizes HOA's to be terminated; provides requirements for termination of HOA; provides conditions for plan of termination; requires approved plan of termination be submitted to community association court program & recorded in public records of each county in which association is located; provides duties & responsibilities of termination trustee; authorizes member to file petition with community association court program; authorizes community association court program to take certain actions; provides responsibilities of board after approval of plan of termination; provides for distribution of assets & paying of lawful debts after association is terminated; specifies unlawful actions by association or its officers or directors; authorizes circuit court to create & administer community association court program; provides duties of chief judge; provides jurisdiction of community association court program; authorizes community association court program to take certain actions; requires each judicial circuit to submit to Legislature specified report annually by specified date; provides duties of OSCA; provides certain funding come from DBPR appropriation

Community Association Management; Requiring certain community associations to contract with a community association management firm; requiring the community association management firm to possess all applicable licenses; providing that association board members, officers, and directors have a duty to ensure such community association management firm or community association manager is properly licensed, etc.

SB 906: Community Associations

GENERAL BILL by Senator Ileana Garcia

Companion Bill (Identical) : SB 908

Homeowners’ Associations; Creating the Office of the Homeowners’ Association Ombudsman within the Division of Florida Condominiums, Timeshares, and Mobile Homes of the Department of Business and Professional Regulation; specifying the powers and duties of the ombudsman; providing the duties of the division relating to the development, construction, sale, lease, ownership, operation, and management of residential parcels and complaints; authorizing the division to issue citations and adopt rules; requiring the division to maintain a toll-free telephone number accessible to parcel owners, etc.

SB 908: Fees/Homeowners’ Associations

GENERAL BILL by Senator Ileana Garcia

Companion Bill (Identical) : SB 906

Fees/Homeowners’ Associations; Requiring each homeowners’ association that operates more than two parcels to pay to the Division of Florida Condominiums, Timeshares, and Mobile Homes an annual fee for each residential parcel operated by the association; requiring that the association be assessed a specified penalty of the amount due if the fee is not paid by a specified date; providing that, until the amount due, plus any penalty, is paid, an association is deemed delinquent and does not have standing to maintain or defend any action in the courts of this state; requiring that all fees the division collects be deposited in the Division of Florida Condominiums, Timeshares, and Mobile Homes Trust Fund, etc.

Effective DateOn the same date that SB 906 or similar legislation takes effect, if such legislation is adopted in the same legislative session or an extension thereof and becomes a law


SB 924: Roofing Material Restrictions for Homeowners’ Associations

GENERAL BILL by Senator Jonathan Martin

Companion Bill (Identical) : 

Roofing Material Restrictions for Homeowners’ Associations; Revising the prohibition on the adoption of certain covenants, rules, or guidelines by a homeowners’ association or a specified committee of an association to include a prohibition on requiring specific types of materials for the building or rebuilding of a roof if the built or rebuilt roof meets certain criteria and standards; revising the prohibited clauses in homeowners’ association documents to include a requirement that a property owner may not be precluded from using any type of building material to build or rebuild his or her roof if the built or rebuilt roof meets certain criteria and standards, etc.

Use of Audioconferencing by Community Associations; Defines "audio conference"; revises list of official records that condominium association is required to maintain to include audio conference recordings; revises association meeting requirements & authorizing associations to use audioconferencing, in addition to videoconferencing, or to use both; revises emergency powers of condominium, residential cooperative, & homeowners' associations to include power to conduct meetings & elections via audioconferencing; revises quorum requirements for residential cooperative association meetings to include audioconferencing.

Condominium Associations; Provides that condominium association's turnover certificate & annual report must be maintained as part of association's official records; requires board of administration of condominium association to file with Division of Condominiums, Timeshares, & Mobile Homes turnover certificate within specified timeframe; requires turnover certificate to include certain information; requires division to maintain publicly accessible online database of turnover certificates, which must include specified information; requires division to create & maintain searchable electronic database of turnover certificates.

SB 1498: Community Associations

Community Associations; Revising a requirement that a developer, before turning over control of a condominium association to its unit owners, have a turnover inspection report for all buildings on the condominium property, rather than buildings that are three stories or higher in height; revising how associations that have not adopted electronic voting must receive electronically transmitted ballots; revising a requirement that a developer, before turning over control of a cooperative association to unit owners, have a turnover inspection report for all buildings on the cooperative property, rather than buildings that are three stories or higher in height, etc.
