More CDD problems ?

There has always been a lot of unrest among the homeowners living in Community Development Districts in Florida. Especially since the big article series in the Orlando Sentinel under the headline : Government Inc.: You Move In. They Cash In! many interested parties looked at these mini governments from a different angle.
According to recent information there are 116 CDDs active in Florida.
But always the same names seem to be popping up when complaints are launched.

There are definitely many Florida Statutes regulating these dictatorial mini governments, especially  FS Chapter 190 - COMMUNITY DEVELOPMENT DISTRICTS. But there are as well many smaller chapters found in the FS, for example FS Chapter 274 - titled : Tangible Personal Property Owned By Local Governments.

And, according to latest information from CDD activists, the provisions of these Statutes are not being followed. Latest research showed that the annual audits as required have obviously not been performed - or the documents are unavailable? 

The law provides that the Custodian (the CDD Manager) of District property is required by Florida Statute, Ch. 274, to perform annual audits of all property belonging to the District.  This includes such property as vehicles, landscaping equipment, golf carts, office equipment and furniture, etc.  Failure to do so is a violation of the Statute.

If you're in doubt please call your district manager and tell him/her that you'd like to review all the inventories for the last seven years. If they are unable or unwilling to comply, feel free to file a complaint with your Florida State Attorney's office. 

According to a very good source of information this is especially the case if SEVERN TRENT ENVIRONMENTAL SERVICES, INC. is the custodian of record. This corporation, according to public information listed on the Web Pages of the Division of Corporations as a Foreign Profit Corporation, is the custodian of about 86 CDDs in Florida, according to latest information. The registered agent is Gary Moyer, with an address listed in CELEBRATION, FL. Remember the CELEBRATION stories?

During the investigative report done by the Orlando Sentinel in 2000, the name Gary Moyer was mentioned very often, mostly not in a real positive way!

Minimum one official complaint has already been filed so far with the 13th Judicial District for violating the Florida Statutes. Are there many more to follow?
