BOCA RATON — GL Homes, which advertises a lavish, luxurious lifestyle in
spectacular homes, is being sued by an area HOA for negligent construction
and alleged violations of Florida’s
building code.
The Tuscany Homeowner’s Association filed suit against GL in Palm Beach
County Circuit Court for a laundry list of alleged community infrastructure
and construction defects.
Among the claimed issues: cracked concrete; broken roof tiles; missing
sealant and weather stripping along door assemblies; crack and spalls in
stucco finish; deteriorated, corroding, and damaged play field equipment;
inadequate distribution of water by irrigation system; condensing units
lacking sufficient clearance and missing vibration isolators; deficient fire
alarm control room supply air configuration; standing water around
mechanical equipment; missing pool equipment equipotential bonding;
unidentified disconnecting means and circuits; missing
electrical installations; missing or malfunctioning light switches;
insufficient lighting; defective electrical power; defective gates;
deteriorated sidewalks and curbs; missing safety railing; ponding water;
defective asphalt pavement; improper slopes on roadways; and more.
According to the suit, “despite multiple verbal and written demands to make
the necessary repairs, Defendants have failed to repair the defects and
deficiencies. As the General Contractor constructing the single-family
homes, various site improvements on an Association-owned property and the
common areas, (the builder) owed a legal duty to the Association and its
homeowner members to perform that work in compliance with the Florida
Building Code, all other applicable laws, codes, and regulations, and the
approved, permitted drawings and specifications for the improvements.
However, despite this legal duty, the various site improvements on
Association-owned property and common areas contain numbers code
violations…”
“GL Homes has literally built tens of thousands of homes in communities
across Florida. As a state-licensed general contractor constructing the
various site improvement on Association owned property and common areas, GL
Homes knew or should have known that the building code violations existed.”

Builders “turn over” their communities to HOAs at a set time in the
construction process. The HOAs then work with the builder to fix work
allegedly completed improperly. If the two sides do not agree, a lawsuit is
filed. Tuscany is a new community north of Atlantic Avenue, just east of the
Florida Turnpike, in Delray Beach.
There was no immediate response filed by GL Homes to the lawsuit.
