Constitutional rights violations of Lynn Myers

Dear Tim Grant & St.Petersburg Times Staff:

         The truly sad thing about the illegal theft of Lynn Myers home is the apathy in America over the loss of our Constitutional Property Rights.  This single mother was denied more than due process.  She is one of 42 million Americans caught under quasi-government traps that lure buyers into homes under the misrepresentation of community homeowner associations exempt from stealing and truth in advertising.
          The average citizen is liable to four governments. City, county, state and federal. When you buy a home in a CDD, Community Devlopment District, you are subject to a fifth level of secret government established back in 1966 by the chief of the Urban Land Planning Bureau, Washington, DC for one purpose and one only.  Complete control of land use.
            By the early seventies HUD received so many complaints of unfair fines, assessments and nonjudicial foreclosures they donated $50,000 of the taxpayers dollars along with $25,000 VA tax dollars to start a nonprofit educational group called: CAI (Community Associates Institute) to educate the volunteer board of directors who are elected to serve these mutual benefit corporations so they could avoid a litgation vortex, like we have.
             Unfortunatedly , the trade associations quickly turned CAI into a cash cow for lawyers and management companies along with brokers and vendors.
               Many CDD lawyers boast they earn millions of dollars yearly filing liens and nonjudicial foreclosing, use a shell company to buy properties for a fraction of their value, turning them over for quick profits that are actually thefts.
                Not one single developer has produced an honest contract that reflects truth in lending because none of them tell the buyer: "Warning, you might lose your home in foreclosure for failure to pay one of our special assessments, a fine or meet the monthly dues without due process."
                 Americans have always felt as long as they meet mortgage payments and state property tax their home is safe. Mortgage companies work with owners to save homes if they are employed or too ill to work etc.  The state will grant up to a year to pay delinquent tax, but the homeowner association moves in for the kill so the lawyers, brokers and insiders profit now runs into the billions.,
              The CAI is now asking congress to change the bankruptcy law so helpless victims of these associations cannot be allowed to write off these excessive fines or foreclosures.
                 The IRS treats each foreclosure as a capital gain and the broken homeowner has to pay a gain on the largest loss of their painful life.
                  The Federal Courts are now being hit with some recourse for the homeowner under a law called, Hostile Housing Environment, which covers harassment.
                   A few have collected legal fees and punitive damages but the losses have already led Jim Troutman of CA to suicide, Al Gray to die of a stress related heart attack and we all read about violent shoot out in Gilbert, Arizona last year...five people shot when a senior citizen lost his condo over a $500 landscaping dispute and had to live in his truck.
                America constantly tells Cuba and China we do not deal with anyone who violates Human Rights.  Yet America sits coldly while CDD/CID lawyers pretend every buyer waives their constitutional rights when they sign the CC&R contract.  The so called CC&R, covenants, conditions and restrictions give no warning buyers will be evicted from their home, lose all equity and end up in the bankruptcy court because they thought they were just obligated to pay maintenance for landscaping or private pools.
               Article 17 in the Universal Declarationm of Human Rights expressly declares, "All are equal before the law and are entitled without any discrimination to equal protection of the law...and Artcile 15 says, " No one shall be arbitrarily deprived of his property", but county and state officials wear blinders because they are afraid to face the tax discrimination they practice to get free money for infratstructure cost.
                 Florida's undefeated, Hall of Fame shooting champ, recently paid cash for a CDD home in Tallahassee to retire debt free. Guess what?  A week after escrow closed she received a packet of legal papers explaining the developer borrowed about 20 million in bond money from the state he had twenty years to pay, so she could not get a title to the home she bought until, and if he paid these bonds off.
                If you hold up a bank you go to jail on felony charges, and yet no action has been taken to stop the criminal theft of homes and savings turning Americans into a homeless society without credit or savings to own another home?
                I buried a husband from World War Two injuries, saw two of my children suffer in our most misrepresented war with Vietnam and I prided myself on our Bill of Rights.
                 Today, I work with the several Property Rights groups like American Homeowners Resource Center  and Cyber Citizens for Justice, Inc. to pressure the committee for Constitutional Rights in Congress to hold a hearing and restore all Property Rights.
                  State Bars forbid excessive fees and unethical acts in every area except CDDs.  The CAI was charged with Unfair Business Practice and trying to create a monopoly back around 1994 but they continue to control about 205,000 CDDS in the US extracting their pound of blood under the pretense buyers violated their contract.

                  Heed the words of Richard Louv, America 11, "Sometime during the decade, the shelter revolution will be complete...no shot will have been fired, but the American notions of private property, local government..and that part of the American dream symbolized by single family suburban homes...will have been permanently altered.  " One wonders what our Founding Fathers would say about the destruction of their dream and sacrifice so that "a man's home could be his castle".
