JUDGMENT FOR PLAINTIFF & AGAINST DEFENDANT.
GEORGE WALKER THIS
CAUSE coming before this Honorable Court on November 2, 2006 and being tried on
this same date, the Court having heard argument of counsel, heard testimony,
reviewed evidence and being otherwise advised fully in the premises, makes the
following finding of filet and reaches these conclusions of law. It is hereupon,
ORDERED AND ADJUDGED that: 1.
The equities are against the Defendant, GEORGE WALKER whose address is
3718 NW 213 Street, 2.
Defendant, GEORGE WALKER. his agents, servants, employees, assigns
or others acting by or through him, shall be permanently enjoined from having
any say in any matter whatsoever having to do with Plaintiff; 3.
Specifically, Defendant GEORGE WALKER is forever precluded from
distributing, mailing, advising, instructing, suggesting or disseminating in any
way shape or form that the Plaintiffs unit owners not pay their maintenance fees
or comply with the rules and regulations which govern the Plaintiff and it' s
unit owners;
4.
The Court has determined that Defendant's Counter-Claim, filed
untimely in this action on or about July 10, 2006 and voluntarily dismissed by
Defendant on November 2, 2006, is a Compulsory Counter-Claim. Therefore,
Defendant's dismissal of said Counter-Claim shall constitute a Voluntary
Dismissal with Prejudice; 5.
Any and all bonds purchased by Plaintiff shall be released and, in
turn, the Clerk of the Court is ordered to return all sums to Plaintiff, its
attorneys, agents or assigns to the full extent of the purchase price of said
bond; 6.
The Court shall retain jurisdiction over the subject matter and
the parties to enforce any and all terms and conditions of this Final Judgment.
