Pennsylvania couple alleges condominium manager, unit owners negligently cared for property

CLEARWATER — A Pennsylvania couple is suing a Belleair Bluffs condominium manager and unit owners, alleging negligence.

David Young and Linda Young of Delaware County, Pennsylvania, filed a complaint Nov. 27 in Pinellas County Circuit Court against Port Belleair No. 2 Inc., Harvey F. Clarizio and Donna J. Clarizio,, alleging failure to maintain and repair the damaged portion of the condominium's common elements.

The suit says in May 2017, the Youngs notified the condo association of a water leak in the apartment directly above their property at Unit 210, 147 Bluff View Drive, Belleair Bluffs. The lawsuit alleges the property is owned by the Clarizios.

According to the complaint, on Sept. 16, 2017, in the aftermath of Hurricane Irma, the Youngs discovered substantial damage to their property due to the serious unresolved plumbing issues with the Clarizios' unit 310, directly above the plaintiffs' unit.

The suit alleges the Youngs suffered remediation, repair, and/or replacement costs and loss of use of their property. The plaintiffs allege the defendants failed to act reasonably to prevent property damage caused by the leakage.

The Young seek trial by jury, damages of more than $15,000, exclusive of interest, court costs and attorney fees. They are represented by attorney William S. Chambers IV of Campbell Trohn Tamayo & Aranda PA in Lakeland.
