WELLINGTON
— A Wellington condo association, unhappy with its termite service,
sued its exterminator and won.
Sheffield Woods at Wellington Condominium
Association won a $413,000 jury verdict in its lawsuit against Orkin
Inc.
In the verdict reached Tuesday, a
Hillsborough County jury found that Orkin failed to control subterranean
termites and failed to re-treat the property at the 192-unit condominium
development. The jury also said Orkin was not responsible for repairs.
Pete Cardillo, a Tampa attorney
representing the association, said Thursday that he had sought $5.6
million in damages. Termites have destroyed extensive portions of the
wood framing and studs in all but two of the 29 buildings, he said.
"Nothing has been fixed yet,"
Cardillo said. "We have removed portions of every single building
to look at the damaged framing."
People can still live in the buildings,
but will probably have to move out during repairs, Cardillo said.
Orkin initially treated the buildings in
1990, with periodic treatments over the past 21 years. Last year a
complete re-treatment was conducted, but that should have been done in
1997 or 1998, Cardillo said.
Martha Craft, a spokeswoman for Orkin,
which is owned by Rollins Inc., said in a statement, "We honored
our commitments and stood by Sheffield Woods for more than 20 years to
provide termite protection to their property. We are proud of the
thousands of Orkin men and women who continue to provide superior pest
control service to valuable customers like Sheffield Woods."
