Couple alleges Treasure Island condominium association violated contract

CLEARWATER — A couple is suing a Treasure Island condominium owner, alleging breach of contract and statutory duty.

Joseph J. Conoslo and Joan M. Consolo filed a complaint July 27 in Pinellas County Circuit Court against Mansions by the Sea Association Inc. alleging violation of the Florida Condominium Act and all other governing documents.

According to the complaint, on April 18, the Consolos, as a unit owner of the defendant's condominium at 7650 Bayshore Drive, Treasure Island, sent notice to counsel for the condo association, arguing that the association's approval of making changes of the plaintiffs' exterior windows is a direct direct violation of the declaration. 

The Consolos say the association's continued approval of these material alterations without the requisite vote by the membership fails preserve and maintain the integrity of the common scheme in the condominium. 

The plaintiffs allege Mansions by the Sea Association failed to obtain an affirmative vote from the required number of unit owners in the condominium, before starting any alterations, and failed to take any action to stop, prevent or remove any of the nonconforming exterior windows.

The Consolos seek trial by jury, damages of more than $15,000, together with court costs, interest, attorney fees and all other just and proper relief. They are represented by attorneys John N. Redding and Aleksandra I. Jagiella of Redding & Associates, PA in Tampa.
