Dear Mr. Murphy:

           I contacted the offices of Clayton & McCulloh based on your representation that their attorneys are now preparing Notices and Liens on behalf of Chapman Groves Homeowners Association, Inc.  Kenneth Clayton advised that he has no record of having prepared any Notices and Liens on behalf of the Association.  I have enclosed a copy of his letter for your reference.

           After a thorough review and investigation, I have concluded that this matter may be resolved with the execution of a Cease and Desist Affidavit.

           Enclosed is an original Affidavit and copies of Florida Supreme Court cases which I offer to you in effort to conclude the unlicensed practice of law investigation amicably.  You will note from reading the Affidavit that you are not required to admit to any wrongdoing on your part.  I seek only your reassurances that you understand the implications of your previous conduct and agree not to engage in any activities which constitute the unlicensed practice of law under existing decisions of the Supreme Court of Florida.  This should not be a problem since you advised that you no longer engage in such activity.

          I urge you to discuss the contents of the Affidavit with your attorney.  I will be happy to talk with your attorney or you, if you desire not to seek counsel, concerning the subject matter of the Affidavit if any questions exist.

          I need to have the Affidavit returned no later than ten days from the date of receipt.  For your convenience I have provided a self-addressed stamped envelope.  If you or your attorney have any questions, please feel free to contact me.

              1 .         Who drafted the lien?  I do not know.  I believe it was a standardized
                           form available on the Internet.
              2.          Who is the attorney representing the Association?  Clayton & 
                           McCulloh, Maitland, Florida.

Dear Ms. Coaxum:

I am in receipt of your letter of May 19, 2003 regarding the above matter involving Mr. Richard Murphy.  With respect to Chapman Groves Homeowners Association, Inc., we do and have represented this Association, but, based upon an inquiry among the Collection Department within this office, I do not find that we have prepared or been preparing Notices and Liens on behalf of this Association.  We do handle legal work for this client but we do not have any open matters for this client involving liens at this time.

In response to your letter dated May 7, 2003, please be advised that I did not prepare the Notice and Claim of Lien. I merely signed it as the Homeowners Association Manager and Agent.

With regard to the complaint by Ms.XXXX  she has repeatedly not paid the Association Assessments and this complaint is one more issue in an effort by Ms.XXXX to cause the Association additional expense because the Board of Directors has not allowed her dogs to run loose in the community.

I am enclosing a copy of the Release of Lien that was issued and please be informed, that this office does not prepare liens any longer.  We have retained the services of a licensed attorney.
