ANALYSIS
We should support this bill. The bill requires
homeowners associations that operate more than two parcels to pay an
annual fee to the Division of Florida Condominiums, Timeshares and
Mobile Homes.
It appears that this bill is seeking to conform to Section
718.501(2)(a), Florida Statutes, which requires each condominium
association that operates more than two units to pay the division an
annual fee in the amount of $4.00 for each residential unit. . The
fee is due by January 1 of each year. If the fee is not paid by
March 1, the association will be assessed a penalty of 10% of the
amount due, and the association will not have standing to maintain
or defend any action in the courts of this state until the amount
due, plus any penalty, is paid.
Unlike the fee of $4.00 per residential unit for condominiums, the
bill does not specify the amount for each residential unit in a
homeowners association. However, the bill does mirror Section
718.501(2)(a), Florida Statutes that an association will not have
standing to maintain or defend any action in the courts of this
state until the amount due, plus any penalty, is paid.
