ANALYSIS

We should support this bill.  The bill if passed, is effective as of July 1, 2026. 

The bill defines “video conference.” The bill emphasizes that video conferences and audio conferences recordings are part of official records. The bill also revises condominium association emergency powers to conduct meetings and elections via audioconferencing. The bill revises the emergency powers of a residential cooperative and homeowners’ associations.

The bill amends the list of official records that a condominium association is required to maintain to include audio conference recordings.

The bill amends the inclusion of video or audio conferencing or both, which are required to be recorded and maintained as part of the official records of the association.

The bill clarifies verbiage relating to elections. The bill replaces “shall be” with “are” that elections “are” decided by a plurality of ballots cast.

The bill clarifies verbiage relating to budget meetings and replaces “shall be” with “is” clarifying that such meetings are open to all unit owners. In addition, the bill provides that audio conferencing and video conferencing (or both) are available methods, and the meetings must be recorded and maintained as official records.

The bill replaces the verbiage “shall” to “must” for a board to simultaneously provide a substitute budget, as well as to replace the verbiage “shall” to “must” in an affidavit of compliance.

The bill amends the emergency powers of an association to include the power to conduct meetings and elections via audio conferencing.
