Happy New Year!

Get  ready!   The 2023 Florida Legislative session is almost here. 

Owners governed under mandatory associations in Florida need their elected officials to enact laws on community association governance  for  uniform, fair and equal treatment, including:

  1. Stricter enforcement of record requests --  including Board and/or CAM denials to owners requesting financial records of the Association and/or destruction of  an official document or record of the Association.

  2. Enforcement agencies that work together to enforce the law --  including the Florida Department of Law Enforcement (FDLE,  representatives from the Department of Business and Professional Regulation (DBPR) and the Office of the Condominium Ombudsman (OCO) to work together ensuring that any complaints by affected unit owners can be dealt with in an efficient, fair and impartial manner.

  3. Punishment on misuse of funds by Boards of Directors and Community Association Managers, including criminal penalties.

  4. Mandatory Education for Board Members  -- not just a certificate acknowledgment but an actual classroom educational forum on roles and compliance for their positions.
