Analysis of HB 437: Homeowners' Right to Display Flags  (Representative James Buchanan)

We should support this bill.  This bill amends s. 720.304, F.S., which governs homeowners’ associations, effective July 1, 2023.  

Regardless of certain prohibitions in the governing documents of the homeowners' association, the provision authorizes homeowners to display up to two specified (permissible) flags no larger than 4 1/2 feet by 6 feet.

Permissible flags are flags of the United States, State of Florida, Air Force, Marine Corps, Space Force, or Coast Guard, and first responders and must be displayed in a respectful manner (as defined under Title 36 U.S.C.84 chapter 10.85).
