Re: House Bill 391 Study

 

Dear Mr. Bergemann,

On June 27, 2006, Governor Bush vetoed House Bill 391, relating to community associations, and directed the Department of Business and Professional Regulation (DBPR) to conduct a study and generate a report regarding several issues contained in the legislation.  These issues include:

  • Finding ways to improve or expand the existing alternative dispute resolution and education programs currently contained in the homeowners association statute, Chapter 720, Florida Statutes;

  • Determining the extent to which protections existing in the statute governing condominiums (Chapter 718, Florida Statutes) should apply to those living in homeowners associations; and

  • Determining whether the State of Florida should consider adopting a single unified statute governing condominiums, cooperatives, homeowners associations and other community associations.

DBPR is now accepting public input regarding these issues and has sent this letter to you as a means to encourage such input. Again, we need to hear from you by September 15, 2006.
