Homeowners' Association Declares War On Dissent

(Valrico, FL)  The Estates at River Crossing Homeowners Association of Valrico has declared war on dissent by members of the association by filing a lawsuit against Mr. and Mrs. George C. Gould, 1310 Riverfield Ct., Valrico, FL 33594.  The lawsuit, filed by the homeowners’ association’s attorneys, Becker and Poliakoff, P.A., alleges that Mr. and Mrs. Gould failed to maintain their lawn in accordance with the association’s Covenants, Conditions and Restrictions (CC&Rs) and that they modified their lawn by planting flowers in an area where the sod was dead without seeking prior approval from the association’s Architectural Control Committee.

The complaint states that absent injunctive relief, the association would be “estopped from compelling compliance by other lot owners with the terms and conditions” of the CC&R.  It further requests the court to order the removal of the offending flowers and resodding the area or to grant the association the right to take over maintenance of Mr. and Mrs. Gould’s lawn, to charge the Goulds, to place a lien on their property, and to award the association its costs and attorney’s fees.

Mr. and Mrs. Gould are in the process of retaining an attorney to answer the lawsuit.

A retired Naval Officer and Vietnam veteran, Mr. Gould stated:  “This lawsuit is about neither our lawn nor flowers nor the CC&R.  My wife and I have expended considerable time, effort and money in improving the functionality and appearance of our property.  After all, who has more incentive to maintain the property?  We have a large capital investment in it.  I am certain that when a judge and jury see all of the evidence in this case, this suit will be laughed out of court.

“This is about power and the abuse of power. This is about Adam Roth (president of the association) and Rick Pitrowski (community manager) refusing to allow any member to question, as I did, their selective enforcement of the CC&R.  This is also about the need for the homeowners of Estates at River Crossing, a small community of only 179 homes, to pay $1,100 a month (over 1/3 of the association’s budget) for a “professional” community manager.  Their response was most instructive in regard to the community manager question.  Roth and Pitrowski said that we needed a manager to ‘hold the homeowners and residents ACCOUNTABLE’!  Since when are the governed to be held accountable to and by the governors?”

The Estates at River Crossing Homeowners Association annual membership meeting will be held on Tuesday, October 19, 2004 at 7:00 PM at the Campo YMCA Multipurpose Room, 3414 Culbreath Road in Valrico, Florida.  The media are invited to send representatives to the meeting where the issue will be discussed.
