CORY LAKE ISLES - Hillsborough Circuit Judge Frank Gomez will decide whether Cory Lake Isles developer Gene Thomason can keep his business finances private.

Mark Basurto, a lawyer representing seven Cory Lake residents in a lawsuit over access to financial records, has subpoenaed financial records for Thomason's Cory Lakes Limited.

Thomason's lawyer filed a motion asking for a protective order. The hearing is scheduled for Jan. 23.

The plaintiffs sued the Cory Lake Isles Property Owners Association in October for access to the financial records for the past five years. They said the association was charged with the responsibility for maintaining and running the 1,000-home gated community, but Cory Lakes Limited directly billed the homeowners nearly $1,500 a year.

The residents say their association dues were deposited directly into Cory Lakes Limited's account, so they should have access to the company's spending records, tax returns, contracts, audits and bank statements.

Two of the plaintiffs, Mark Lee and Curtis Perry, have been deposed by the association's lawyer, Philip Friedman. Basurto plans to depose the association's president, Jane Taggart, in January.
