Valencia Reserve Homeowners Association Sued
“Active Adult” Community Unsafe, According To Lawsuit

BOYNTON BEACH — The Homeowners Association at Valencia Reserve is facing a lawsuit from a man who says the HOA was negligent in the care of its clubhouse. The man fell and claims critical injuries.
 

Richard Blutig, in his lawsuit, says he was in or near the property at 9275 Lake Royal Road in Boynton Beach on December 21st, 2020 as a “business invitee.” The suit alleges that the HOA “carelessly” and “negligently” failed to maintain the grounds on its premises in a “reasonably safe condition,” and created “a dangerous condition” for those “ambulating.”

The suit, filed by Miami attorney Diana Usten, makes no mention of the actual negligence or what led Mr. Blutig to fall. It was unclear if he says that he fell in the clubhouse or on clubhouse grounds.

According to the suit, Mr. Blutig, “suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, aggravation and/or acceleration of pre-existing condition(s), loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, and the loss of ability to earn money in the past and future.”

The Valencia Reserve HOA is being sued.


 

There was no immediate response filed by the Valencia Reserve HOA. Local Real Estate Expert Zev Friedus tells us that, “Valencia Reserve is a single family residence community located in Boynton Beach Florida with seven homes currently for sale between $650,000 and $997,500.” GL Homes marketed the community as an “active adult” community, the term it uses for communities that focus on those age 55 and older.
