An Ormond Beach family is fighting its homeowners association over whether it
can park wrapped work trucks in its own driveway, a dispute that could come down
to how Florida law limits HOA restrictions.
|
Mike and Jodi Skroskznik use the trucks
for their pool-cleaning business. But Wexford Reserve's
existing rules restrict the use of wrapped vehicles, putting
the family at odds with the association.
"We got them wrapped when we found out that the Florida law
changed," Jodi Skroskznik said.
The family said it hired an attorney after the dispute
escalated.
"And that's when we felt the need to hire an attorney to
protect ourselves and the right to park our vehicle in the
driveway," she said.
Following mediation between the family's attorney and the
HOA board, the issue is now headed to a community vote.

"Basically, it's gonna say if you want to allow vehicles to have logos on
it, vote yes. If you don't, vote no," Mike Skroskznik said.
The family also raised concerns about the potential cost of the dispute to other
homeowners, who pay association dues that can help cover legal expenses.
"Because every homeowner pays into HOA dues, and part of that is attorney fees,
and there's only an allotted amount per year," Jodi Skroskznik said.
Florida law changed in 2024 to limit homeowners associations' ability to
prohibit certain vehicles from being parked in homeowners' driveways, including
qualifying work vehicles with visible business logos.
Attorney Mark Lippman, who is not involved in the dispute, said he believes the
law protects the family's ability to park its truck at home.
"I do think the homeowner has the right to have his truck there," Lippman said.
Lippman said HOA rules do not automatically override state law simply because
the association adopted its restrictions first.
"Just like any other law, when it goes into effect, it affects everyone now," he
said.
"Sometimes they say the word grandfather clause or their rules should be
controlling because they were there first. Statute controls."
Channel 9 reached out to the Wexford Reserve HOA president and the company that
manages the association for comment. We are still waiting to hear back.
Homeowners are expected to vote next week on proposed changes to the community's
rules governing commercial vehicles.
