BOCA RATON — Homeowners in the Boca Raton community of L’Ambiance are suing the
Homeowner’s Association and its board of directors, claiming that the HOA is
taking money and not providing required services and maintenance. The suit was
just filed in Palm Beach County Circuit Court.
According to the
complaint obtained by BocaNewsNow.com, Amanda Beraglia and
Daniel Weinstein purchased a home in December of 2020 and —
while taking title — received documentation confirming that
the HOA is responsible for “exterior walls” in the community
of townhomes and villas. But despite that written guarantee,
the HOA allegedly let the walls of the home deteriorate. The
deterioration was allegedly so pronounced that water
permeated the home and mold spread throughout.
“On or about June 10, 2022, Defendant (The L’Ambiance HOA),
breached its duty to Plaintiffs by failing to maintain, at
the Association’s expense, exterior walls of the Plaintiff’s
property. On or about June 10, 2022, as a consequence of the
Defendant’s breach of Maintenance Duty, the Plaintiff’s
Property suffered from water intrusion and mold damage,
resulting in damage to Plaintiffs.” |

Alleges the complaint: “The Plaintiff’s property was damaged by water
intrusion which originated from a source that the Defendant was obligated to
maintain, repair, and replace: the exterior walls.”
The suit seeks in excess of the statutory minimum for filing in Palm Beach
County Circuit Court — $50,000. L’Ambiance did not immediately file a
