CERTIFICATION PROGRAM

 

As of July 1, 2010, newly elected or appointed CONDO BOARD MEMBERS must submit a certificate of satisfactory completion of an educational course approved by the Florida DBPR, or an affidavit attesting that they read Florida Statute 718 and all of their governing documents.

Attorney Eric Glazer, host of the weekly radio show CONDO CRAZE & HOA'S has been approved by the Division to certify directors throughout Florida and teach them about their responsibilities under Florida law.  These responsibilities include such topics as Budgets and Reserves, Financial Reporting, Condominium Operations, Records Maintenance, Access to Records, Dispute Resolution and more.  In addition, highlights of the new condominium laws will be taught in detail.  Of course, there will also be a question and answer period at the end.    

  

Attorney Eric Glazer has practiced Florida association law since 1992.  He is from the law firm of Glazer &Associates P.A. in Hollywood. Eric Glazer is NOT a member of the CAI (Community Associations Institute), the trade organization of the community association service providers.  Glazer’s teaching is not influenced by CAI politics that usually accompany all the courses of the bigger law firms.

Every condo owner can participate -- your association does not have to be a client of Glazer & Associates P.A. And even if you are not yet on a Board of Directors, if you attend, you will still receive certification and will then not be required to attend another course if subsequently elected as a member of the board.

FS 118.112(2)(d)3.b. Within 90 days after being elected or appointed to the board, each newly elected or appointed director shall certify in writing to the secretary of the association that he or she has read the association’s declaration of condominium, articles of incorporation, bylaws, and current written policies; that he or she will work to uphold such documents and policies to the best of his or her ability; and that he or she will faithfully discharge his or her fiduciary responsibility to the association’s members. In lieu of this written certification, the newly elected or appointed director may submit a certificate of satisfactory completion of the educational curriculum administered by a division-approved condominium education provider. A director who fails to timely file the written certification or educational certificate is suspended from service on the board until he or she complies with this sub subparagraph. The board may temporarily fill the vacancy during the period of suspension. The secretary shall cause the association to retain a director’s written certification or educational certificate for inspection by the members for 5 years after a director’s election. Failure to have such written certification or educational certificate on file does not affect the validity of any action.
