Amendment 4 will give you a vote on development!

Reckless over-development has diminished our quality of life, raised our taxes, and lowered our home values.  Amendment 4 gives citizens a seat at the table by enabling voter approval of development-related land use plan changes.  Our homes and communities are too important to leave in the hands of politicians, land speculators and lobbyists hired by developers!  Find out what Amendment 4 will mean to you.

John Dunn is a native of Miami and currently lives in Ocala .  He is married, a father of two daughters, a high school social studies teacher, and a freelance writer.  He is an activist with the Florida Hometown Democracy movement that has led to the placement of Amendment 4 on the upcoming November ballot.

Ron Woodard is a Florida native who grew up, fished and hunted on land where The Villages complex now stands.  He is married and is an elementary school physical education teacher in Marion County , an outdoorsman, and a Navy veteran.  He is a committed supporter of the Florida Hometown Democracy effort.

Both Dunn and Woodard helped to found the Smart Growth Coalition of North Central Florida, a Marion County based grassroots organization dedicated to raising public awareness about issues of growth and urban sprawl.  Along with hundreds of other volunteers across Florida , they have worked for the past six years to get Amendment 4 on the ballot in the November 2010 election.  

ARE HOMEOWNERS USED AS CASH COW BY DEVELOPERS?

CCFJ President Jan Bergemann will discuss the problems homeowners living in developer-controlled homeowners’ associations are facing – problems caused by the Florida legislature’s failure to protect these homeowners.  We’ll discuss extreme examples and what owners can do to protect themselves against dictatorial developers and association boards.  Jan will tell you about more problems caused by recently enacted community association bill S 1196.

Barbara Billiot Stage, Esq. is a partner of the Law Offices of Stage & Myers in Orlando .  Barbara’s firm practices community association law and foreclosure defense.  However, Barbara’s practice is limited to providing homeowners with defense against their associations and represents a handful of associations that are committed to operating in an ethical manner and in accordance with the law. Barbara will discuss the legal issues of the homeowner/developer problem.

Ralph Udick will make a presentation titled "What's Wrong with FL Statute Chapter 720"   A retired Army colonel with 30 years of active service, Ralph is a homeowner in the HARBOR HILLS HOMEOWNERS' ASSOCIATION, INC. in Lady Lake and has experience dealing with developer problems.  Ralph's presentation will focus on three problems:

1.      The constitutionality of developer control in light of our inalienable right in Florida to acquire, possess and protect property, combined with the fact that the power of the association board, elected or appointed, must be reasonably limited. 

2.      The need for enforcement mechanism other than lawsuits.

3.      The problem that is typical of almost all regulations – unclear wording in key places and the need for clarity in key provisions.
