Century Village Building Management Company Claims It Has Right To Enter Any Unit At Any Time To Determine If Owners Are Compliant With Rules.

BOCA RATON — The owners of a unit at Century Village Boca Raton are being sued by “Dorset at Century Village” because they won’t permit Comcast entrance to their unit — entrance allegedly needed to provide cable to a next door neighbor.

Under the declarations allegedly agreed to by owners in the Dorset building at Century Village is language that property management claims gives “right of entry by association and management firm whenever it is necessary to enter any unit for the purpose of inspection. including inspection to ascertain a Unit Owner’s compliance with the provisions of this declaration.”

In simple terms: Century Village management claims it can enter any unit at any time to see if owners are complying with rules set by Century Village management.

But owners Michelle, Julia, Antoinette, and Josephine Martorana apparently are saying, “no way.” They are refusing to permit entry into their unit for the purpose of permitting Comcast to fix cable in a neighboring unit. It’s unclear why Comcast can’t run a separate line into the unit in question. It is not addressed in the lawsuit.

Dorset at Century Village seeks a “temporary and/or permanent injunction against the Defendants requiring the Defendants to comply with the Declaration, (and to) immediately provide the Association and Comcast representative with access to the property so that the necessary repairs and maintenance can be performed in order to provide cable service to the neighboring unit.”

A court date has not yet been set.
